Electronic Disclosure Consent Agreement
This Electronic Disclosure Consent Agreement (this “Consent”) applies to all communications, documents, disclosures, notices, agreements, and records (collectively, “Communications”) that RE/MAX Dorado Real Estate LLP (“we,” “us,” or “our”) provides to you, or that you sign or agree to at our request, in connection with your use of our website, products, and services. By accepting this Consent, you agree that we may provide you with any and all Communications in electronic form, and that we may use electronic signatures and obtain them from you, in lieu of paper documents and handwritten signatures. Please read this Consent carefully and keep a copy for your records.
Definitions. “Communications” means each disclosure, notice, agreement, statement, receipt, record, document, or other information we provide to you, or that you sign or submit to us, regarding your relationship with us. “Electronic Record” means a contract or other record created, generated, sent, communicated, received, or stored by electronic means. “Electronic Signature” means an electronic sound, symbol, or process attached to or logically associated with a record and executed or adopted by a person with the intent to sign the record.
Scope of Consent. Your consent applies to all Communications relating to your use of our website and the real estate services we provide, including registration and account information, property inquiries, tour and showing requests, transaction-related documents, marketing and promotional materials you have elected to receive, and updates to our policies, terms, and agreements. This Consent remains in effect for so long as you maintain a relationship with us, unless and until you withdraw it as described below.
Duration of Consent. This Consent will remain in effect until you withdraw it or until we terminate our relationship with you. You may withdraw your consent to receive Communications electronically at any time by contacting us using the information provided at the end of this Consent. If you withdraw your consent, the legal validity and enforceability of Communications provided to you electronically before the withdrawal took effect will not be affected. We may treat your withdrawal of consent as a request to terminate your access to certain online services.
Right to Paper Copies. You have the right to receive a paper copy of any Communication we provide to you electronically. To request a paper copy, please contact us using the information at the end of this Consent. We may charge a reasonable fee for providing paper copies, and we will notify you of any such fee before processing your request. Requesting a paper copy of a particular Communication will not, by itself, withdraw your consent to receive Communications electronically.
Delivery Methods. We may provide Communications to you electronically by (a) sending them to the email address you have provided to us; (b) posting them on our website or within your online account, where applicable; (c) sending you a notice directing you to a location where the Communication is posted; or (d) any other electronic means reasonably calculated to reach you. You agree to keep your contact information, including your email address, current and accurate, and to promptly notify us of any changes so that we can continue to deliver Communications to you.
Updating Your Contact Information. It is your responsibility to provide us with a true, accurate, and complete email address and other contact and identifying information, and to maintain and update that information. You can update your information by editing your account profile or by contacting us directly. We are not responsible for any failure to deliver a Communication that results from inaccurate or outdated contact information you have provided.
Signature. By selecting an “I Agree,” “Accept,” “Submit,” or similar button, checkbox, or field, or by otherwise using our website and services after being presented with this Consent, you are providing your Electronic Signature and you agree that such action constitutes your signature, acceptance, and agreement as if actually signed by you in writing. You further agree that your Electronic Signature has the same legal effect, validity, and enforceability as a handwritten signature, to the fullest extent permitted by applicable law, including the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law.
Hardware and Software Requirements. To access, view, and retain Communications provided to you electronically, you will need: a personal computer, smartphone, tablet, or other device with internet access; a current version of a major web browser (such as Google Chrome, Mozilla Firefox, Microsoft Edge, or Apple Safari) that supports 128-bit encryption; a valid email account and the software necessary to send and receive email; sufficient storage space to save Communications or a printer to print them; and software that allows you to view, save, and print documents in common formats such as PDF. By consenting, you confirm that you have access to the necessary hardware and software and that you are able to receive, open, and read electronic Communications from us.
Security. We take reasonable measures designed to protect the security and confidentiality of Communications provided to you electronically. However, the internet is not a completely secure environment, and we cannot guarantee that Communications will not be intercepted, accessed, or altered by unauthorized third parties. You are responsible for safeguarding your login credentials, devices, and email account, and for ensuring that only authorized individuals have access to Communications we send to you. Please notify us immediately if you believe the security of your account or any Communication has been compromised.
